The “Debora” case turned out to be too hot a potato for the magistrates in Stara Zagora and will hardly be heard by the District Court in the city, although the indictment against Georgi Georgiev was filed there on December 15. District judges en masse recuse themselves and do not want to deal with the case. This reports “Now“. So far, 11 magistrates have recused themselves, including the president of the court, Blaga Bozova (see below who are the others). If all the magistrates from the court recuse themselves, the Supreme Court of Cassation will have to consider where to send the case. Usually a nearby court of the same level (in this case – regional) is chosen, so as not to cause additional inconvenience to the participants in the process.
From the publicly available data it is clear that they all refer to the text from the Civil Procedure Code, which says that “a judge or juror who, due to other circumstances, can be considered biased or interested directly or indirectly by the outcome of the case”.
The “Deborah” case is already “running around” among the civil judges and they are also being taken away. The last withdrawal is from December 28. Yesterday, the case was assigned to judge Nedelina Mincheva. The lot is then drawn between a total of five magistrates. So it remains to be seen whether Judge Mincheva will find a reason to withdraw. According to the court’s website, there are 20 district judges in Stara Zagora – 9 criminal and 11 civil.
26-year-old Georgi Georgiev will answer to three charges after 5 months earlier the society was “blown up” by the brutality of the crime and the neglect of the case by the authorities.
The first charge against Georgiev, who is currently in custody, is that on June 26, with particular cruelty and in a particularly painful way for the victim, by striking the head with a fist and 18 cuts with a dummy knife, he caused the 18-year-old girl two degrees of moderate bodily injury and disfigured her. For this crime, the Criminal Code stipulates from 2 to 10 years in prison. The second charge is that on June 26, he forced the victim to suffer something against her will by cutting off part of her hair with an electric clipper, using force, punching her in the face. The punishment for this is up to 6 years in prison. The Criminal Code provides the same punishment for Georgiev’s third accusation – that in the period from April to June 25 of this year He threatened to kill Deborah 6 times.
The judges who have so far accepted that due to some circumstances they may be considered biased or interested directly or indirectly in the outcome of the case are Rosen Chilikov, Blaga Bozova, Todor Minov, Hristo Angelov, Darina Krumova-Stoyanova, Dimitar Mandjurov, Ivan Rezhev , Olga Zlateva, Tanya Ilkova, Svilen Zhekov, Antonia Toneva.
