According to the Advocate General, systemic or general irregularities that could be found with regard to the independence of Polish courts do not deprive these courts of the nature of judicial authorities. – Courts remain judicial organs despite the fact that the independence of the judiciary has been threatened – he pointed out.
The Advocate General pointed out that, even if the threat to the independence of Polish courts may have increased, all European arrest warrants issued by those courts cannot be suspended, in advance and automatically.
The ombudsman’s opinion is an introduction to the CJEU judgment in this case. The Court can agree with it, and it usually does, but it may make a different judgment.
