The report from President Joe Biden’s handling of classified documents was made public on Thursday. Special investigator Robert Hur concluded that the president has shared confidential information with intent, but that there is no basis for bringing a criminal case.

One of the reasons Hur points to is that Biden is old. The president is 81 years old. The special investigator believes that Biden, in front of a jury, would probably look like a “sympathetic, well-meaning man with a bad memory.”

“In the interview with our office, Biden’s memory was worse. He did not remember when he was vice-president and forgot on the first day of the interview when his vice-presidential term ended (“if it was 2013, when did I quit as vice-president?”). On the second day of the interview, he forgot when his vice presidential term began (“in 2009, am I still vice president?”). He did not remember when his son died.”

The interviews with the ministry should have been conducted in 2023. But Hur believes that Biden’s memory was already limited in 2017. The special investigator has heard through conversations with Biden’s co-author, and describes them as “very slow”.

Biden’s team hits back hard. Advisor Richard Sauber and Biden’s lawyer Bob Bauer write in a letter dated February 5, 2024 that they do not think the descriptions of Biden’s memory are correct or appropriate. Sauber emphasizes that it is common not to be able to recall memories from several years back in time.
“Such comments do not fit in the Ministry of Justice’s report”, he writes.

In the letter, they also point out that the interviews started the day after the attack on Israel took place. Sauber also claims that Biden is being treated differently, as other witnesses have also had problems remembering, without it having been described in such a way.
“Not only do you treat the president differently, but you also use prejudiced terms,” the lawyers write in the letter.
In conclusion, they ask Hur to consider their points carefully before finalizing the report.
