Smith was appointed to lead two federal investigations into the former president:
1: Trump’s handling of classified documents. 2: Trump’s role in the attack on Congress on January 6, 2021 and his attempt to overturn the presidential election.
Trump is charged in both criminal cases, and must appear in court on May 20 and March 4 next year, respectively.
Last week, a federal judge rejected Trump’s petition claiming he is immune from prosecution in the second criminal case against him. Trump has appealed the decision, but to avoid a lengthy appeal process, Special Investigator Smith has asked the US Supreme Court to intervene.
Formally, Smith has asked the United States Supreme Court to urgently deal with the issue.
“This case turns on a crucial question at the heart of our democracy: Whether a former president enjoys absolute immunity from federal prosecution for crimes committed while in office,” Smith’s petition to the Supreme Court said. according to NBC.
