According to the indictment, a 37-year-old man with a fishing license caught a 17-pound and a 28-pound carp from the lake in Balatonkenese in June 2020, which, according to current regulations, he should have released back into the lake after their objection and photographing.
The larger fish was a 120 cm long capital carp, which had been captured from Lake Balaton several times in photographs in previous years, and then released back into the water according to the rules.
The man instead sold the two fish, whose objections were not recorded in the logbook, to a 66-year-old pond farmer in Tolna County, who paid them HUF 345,000, while the real value of the two fish was HUF 535,500. The pond farmer bought the fish even though he knew they were both from Lake Balaton and the seller stole them that way. One of the fish was later caught from the fishing pond and the success was also proudly posted on the internet and then the fish was released back into the lake.
However, the fish has characteristic lesions that facilitate its identification, so it was recognized at the Balaton fish farming company and the pond farmer was informed that the animal was in Lake Balaton. Thus, on the next objection, the pond farmer notified the company’s employees, who transported the fish and released it back to Lake Balaton.
Since it was not possible to identify the smaller fish, the remaining damage of HUF 107,000 was compensated to the victim by the fisherman.
In his indictment, the prosecutor’s office filed a motion to apply to the Veszprém District Court for the application of a probation measure in criminal proceedings against defendants with no criminal record, and to confiscate property to the extent of the fisherman’s profit from the crime. In the meantime, the court sentenced the two defendants to probation for 2-2 years, according to the motion, and confiscated property against the perpetrator of the theft. The order is not final.
