An idyllic single-family home with its own garden – a place that represents peaceful family life. But for Ramona Beyerlein and her two daughters, this image was suddenly shattered. An excavator driver damaged a power line during construction work on the opposite side of the street, causing a power surge in the house. The expensive heat pump burned out, a total loss. Ramona reported the damage to the construction company, which, together with the insurance company, wanted to cover the repair costs, as Ramona was assured in writing.
Heating repair costs 19,000 euros
She then hired a heating engineer to repair the damage and received an invoice for almost 19,000 euros. Despite the construction company’s promise, they only paid her back a fraction of that – 3,400 euros. The single parent was left with a significant amount, over 15,000 euros.
“I can’t understand why they don’t pay more now. I wasn’t even home when this happened. This is harm done to me. I can’t help it, it can happen for God’s sake, but then I have to make it up to you somehow. “So for me that’s an enormous amount of money that I have to manage,” complains the mother of two.
Construction company denies liability for damages
However, when asked by “Sat.1-Bayern”, the construction company claimed that it had never guaranteed a specific type of damage coverage. It is clear that the person who caused the damage must be liable. The amount of compensation depends on whether a repair is possible or whether the current value must be reimbursed. Ramona could get a new heat pump if no comparable used equipment is available, but the construction company could argue that it only has to reimburse the current value if the new pump represents an increase in value, explains lawyer Wolfgang Steger.
Ramona has a good chance of getting the promised money from the construction company, but she will probably have to sue if they don’t budge. Until then, she has to cover the costs for the new heat pump herself, which represents a major financial burden for her.
