Shootout with SEK forces in Hamm for the accused without legal consequences – deployment in Viktoriastraße

The dangerous shootout with a special police force has no legal consequences for a 43-year-old man from Hamm.

Dortmund / Hamm – The accused had published at least one disturbing video in the social networks in the early summer of 2020, thus putting the police on alert. In the recording, the man announced, among other things, that blood would soon flow. Definitely not his. Now the Dortmund jury acquitted the accused and did not order him to be placed in a closed psychiatric clinic.

Because it was feared that the 43-year-old had a live firearm, the police decided to storm the apartment on Viktoriastrasse in June. SEK officers entered the man’s bedroom through the window early in the morning in order to overpower it.

In fact, the 43-year-old had a pistol lying next to him. And before the officers could identify themselves as police officers, he fired a first shot.

Accused apparently surprised

During the trial, however, the accused had asserted that he had never fired specifically at the alleged attacker. And besides, he had no idea who was storming into his apartment with great enthusiasm. He only noticed that the masked men were SEK officers when they in turn made him incapable of fighting with gunshots in the leg.

In their judgment, the judges assumed that the man actually acted in self-defense and therefore cannot be held accountable for the act. A video that perfectly documents the deployment of the SEK had shown that the first calls “Here is the police!” Really only sounded after the shot.

Because the 43-year-old had to be acquitted, the placement in the closed psychiatry that the public prosecutor originally sought was impossible. The accused is considered to be seriously mentally ill. The prosecution wanted to get the judges to classify him as a danger to the general public and to pull him out of circulation.
