A woman from Kamouraska, 22 years old at the time of the facts, pleaded guilty to a luring charge for requiring intimate photos of a young boy only 11 years old.
In September 2019, Marie-Pier Martin from Saint-Pascal started a chat on Messenger, Facebook’s chat site, with the little brother of a friend who was only 11 at the time.
The young woman, who was twice the child’s age, wrote that she had feelings for the latter.
“The accused compliments the child, tells him that he is beautiful and that she wants to go out with him,” summed up the Crown prosecutor in Rivière-du-Loup Me Manon Gaudreault.
During these conversations, Marie-Pier Martin invited the child to her room and to her bed “to do business”.
Facebook collaborates
The accused took her requests further by asking her victim to send her intimate photos of her genitals.
“Following a certain insistence, saying she was tired and feeling obligated”, the victim finally sent two photos of his penis by Messenger.
On September 23, 2019, Facebook detected the two child pornography files sent on its email and forwarded the information to the police who located the victim.
Marie-Pier Martin was finally arrested a year after the fact, in September 2020.
Minimum penalty contested
The woman, who is now 24, has pleaded guilty to two charges of luring and possession of child pornography.
His lawyer, Me Félix Pouliot affirmed that his client’s actions were made in the context of alcohol consumption.
Still, Marie-Pier Martin, who has no criminal record, faces a heavy minimum sentence of six months by pleading guilty.
A request for a pre-sentence and sexological report has been made, after which his lawyer will challenge the constitutionality of the sentence, next November.
