SHB Chairman Roland Lang Takes Action Against Insurance Company’s Monolingual Letter in Italian

Bozen/Terlan – About 2 weeks ago, Roland Lang received a letter from his insurance company, only in Italian. Since the SHB chairman had already tried and won a lawsuit at the Bolzano administrative court years ago, he also asked the insurance company to provide a German translation of this monolingual letter. And got it too!

As early as September 2014, Lang had cited an assurance before the administrative court because she had not responded to a request for a translation of a letter. At that time, the administrative court-autonomous section for the province of Bolzano unequivocally stated: “The policyholder has the subjective right that the documents relevant to the contract are also written in German so that he can understand them.” And sentenced the insurance company to reimburse the legal costs to the appellant , which were valued at EUR 500.00 in total. Since Lang had defended himself, he received this money.

Two weeks later, Lang received the letter in his native language. Even the footer had been translated. The insurance company had apparently correctly recognized that the applicant was right.

The support from the Anti-Discrimination Agency of the Province of South Tyrol deserves special mention in this context. The director, Mrs. Dr. Priska Garbin pledged her office’s support in this matter.

Dear Mr. Lang, we have received your complaint to the insurance company “Generali Cattolica” for non-compliance with the obligation to use the German language for communications. If there is no response from the insurance company within a reasonable time, please do not hesitate to get in touch with us again.

Despite receiving a German translation, the SHB chairman is not satisfied with what has been achieved. The right to our mother tongue is enshrined in the Decree of the President of the Republic no. 574 of 15.7.1988. So it is a law. Nevertheless, the German South Tyroleans receive daily communications only in Italian.

This violates a law and the rights of a minority again and again, and even the state government has recently started asking German South Tyroleans about addresses in Italian. The South Tyrolean Heimatbund will never tire of bringing such language violations to the public and, if necessary, challenging them in court, promises the chairman of the South Tyrolean Heimatbund, Roland Lang.
