In court, Finn said that he feared for his safety at work – but emphasized that he did not care so much that he was cursed and called “c ** nt”.

He told the three male judges that the most painful thing was to be called a skull.

Chief Justice Jonathan Brain then stated this:

– Although this type of language – as far as we understand – was common in this workplace, it is in our assessment across the border when you make personal comments about the appearance of an employee.

Violation and humiliation

Furthermore, the judges stated that it was challenging to conclude with anything other than that “skull fuck” was said to both humiliate, insult and humiliate Finn.

– It was a violation of the complainant’s right to dignity. It created a frightening environment for him, and it was linked to the complainant’s gender, the judges said.

They concluded that he had therefore been subjected to sexual harassment.

– In our opinion, there is a connection between the word “skull” on the one hand and the protected characteristics of one sex on the other, the judges said.

– Women can become bald

In court, the judges stated that being called a skull is most often used about the male sex.

The employer’s defender argued against this, saying that women can also be bald.

– Being a skull is much more common in men than women. Therefore, we believe that it is related to gender, the judges replied.

The Telegraph writes that Tony Finn in a “landmark verdict” was upheld in that he had been subjected to sexual harassment and invalid dismissal.

He thus won the case and was awarded compensation. The amount of compensation has not yet been determined.

After the verdict was handed down, Finn stated according to the newspaper that he hoped that the verdict would put an end to other men “being verbally assaulted and intimidated because they are bald”.

The British Bung Company calls the court’s conclusion “surprising”.
