Severely disabled young man has to answer for crimes

A 21-year-old was charged with seven crimes and administrative offenses in court. “He is actually the victim and not the perpetrator,” asserted his defense lawyer. Not without good reason, as the trial before the youth judge at the Gemünden District Court showed. Some of his false friends had shamelessly taken advantage of the mentally retarded defendant.

It took the public prosecutor seven minutes to read out all the points against which the defendant was accused. However, at the end of the trial, only three crimes remained, for which the 21-year-old had to answer. The young man who does not have a permanent residence has to do 200 hours of social work.

Unsuccessful moped theft

A brazen act, committed on May 27, 2019 in Gemünden, opened the round of allegations. At the train station he stole a moped with which he “wanted to drive around”. However, he did not start the engine by pedaling. At the beginning of the pedestrian zone he asked a passer-by if he could help him. But he realized that it was his friend’s moped and refused to help. When the thief tried to flee, he was grabbed. The helper had the ID card shown and photographed it with his cell phone.

A few weeks later, the defendant and another person brought a game console and accessories stolen from an apartment in Rothenfels to a shop in Aschaffenburg. There the items were sold for around 400 euros. However, the defendant was left empty-handed in the deal.

Because a friend always does it that way, the homeless man stole a bicycle worth 200 euros from a garage in Reichenberg. “Because a buddy wanted that,” the defendant picked up a package of marijuana on May 1, 2020 in Gemünden. In Würzburg he was questioned by the police as part of a group that violated the existing hygiene regulations. He handed over the small amount of anesthetic.

During a total of 14 trips between Gemünden, Karlstadt, Würzburg and Schweinfurt, the defendant was caught on Deutsche Bahn trains without a ticket. This lost 150.30 euros in fare. Here the defendant and his defense lawyer saw a great complicity in the court-appointed supervisor. This had not taken care of the requested application for a token for the severely handicapped ID so that the accused can use local public transport free of charge.

Slapped the ex-girlfriend in the face

After his girlfriend broke up with him and took another boyfriend, the 21-year-old freaked out in July 2020. When he met the couple in Würzburg, he threw a glass bottle in their direction, but it missed its target by a long way. He tried to injure his ex with the broken glass, but did not succeed. To do this, he showered her dress with Coke, pulled her into a bush and slapped her face.

Help instead of punishment, suggested the public defender for his client. “He can be easily influenced and does what you tell him without questioning,” said the lawyer. Both the public prosecutor and Judge Volker Büchs took this into account in his application. In addition to the 200 social hours, the defendant must immediately contact the Christopher Society in Würzburg on a court order in order to receive immediate accommodation. Subsequently, the Caritas Johann Weber House in Würzburg and the Mainfränkische Werkstätten were recommended to him as contact persons.
