Sergio Valls, elected by majority to head the council for peaceful conflict resolution

Mexico City. Sergio Arturo Valls Esponda, official of the Judicial Branch of the state of Mexico, won by 27 votes to three over Rafael Lobo Niembro, representative of the Judicial Branch of the Federation (PJF), the first presidency of the National Council of Alternative Dispute Resolution Mechanisms ( CNMASC), body that will be in charge of promoting agreements between natural or legal persons who, voluntarily and individually or collectivelydecide to resolve a conflict before their case is settled in court.

The importance of this organization lies in the fact that one of its powers is issue operating guidelines for public and private centers for alternative dispute resolution mechanisms and thereby serve as mediators between companies or individuals in the event of a conflict, as part of the justice system.

According to information obtained by The ConferenceValls Esponda, son of the late Minister Sergio Valls Hernández, was endorsed by the majority of the representatives of the country’s highest courts of justice, while the person in charge of the Alternative Mechanisms Body of the PJF, who was appointed by the Minister President of the Supreme Court of the Nation, Norma Lucía Piña Hernández, only received three votes.

Another important factor of this organization is that it will be in charge of issue guidelines for training, evaluation, certification, renewal, suspension and revocation of facilitators and will create a national platform of negotiators, in accordance with the provisions of the General Law of Alternative Dispute Resolution Mechanisms.

The process to elect the president and technical secretary of the CNMASC took place last week in Mexico City and was headed by Piña Hernández, also head of the PJF, and there the presidents of the higher courts of justice decided that magistrate Valls Esponda, of the state of Mexico, and Nancy Gutiérrez Jiménez, from Hidalgo, will occupy those positions, respectively.

On April 19, the Federal Judicial Council (CJF) issued a press release in which it indicated that the CNMASC will have a fundamental role in promoting the effectiveness of these non-jurisdictional procedures.

Regarding the election, in the statement the CJF only indicated that Valls Esponda, general director of the State Center for Mediation, Conciliation and Restorative Justice of the Judiciary of the state of Mexico, was chosen to head the CNMASC. But the Federal Judiciary did not report that that same day, according to Lobo Niembro’s X social network account (formerly Twitter), Minister Piña had appointed him as head of the PJF’s MASC.
