A military judge at Guantanamo has declared a September 11 defendant incompetent to stand trial after a military medical panel found that abuse he suffered in CIA custody years earlier left him permanently psychotic. A spokesman for the Guantanamo military commission, Ronald Flesvig, confirmed the sentence of the judge, Colonel Matthew McCall. The decision means that Ramzi bin al-Shibh will not be tried alongside his four co-defendants, whose case will now proceed without him.
