Adams Armaturen GmbH on Baukauer Straße with its 195 employees, 15 trainees and five vacant apprenticeships will in future be able to do without a works manager. The two managing directors have taken on his duties, and the contact person for the trainees will be an employee from production in two years at the latest, who will then take over the supervision of a colleague who is retiring. Sobering facts for the former operations manager, who received the timely and operational dismissal as of January 31, 2021 at the end of August 2020 and brought an action for protection against dismissal before the labor court with attorney Potthoff-Kowol (halloherne reported).
The manager, who has been with the Swiss family company for 13 years and who most recently received 10,500 euros gross plus company car per month, was not only responsible for training, but was also responsible for construction as a mechanical engineer in production. By telephone, plaintiff’s attorney Potthoff-Kowol and attorney Hansen, representing the employers’ side of the process, had “already approached each other somewhat”, as Potthoff-Kowol told the Chamber of Labor Judge Kühl, but that a breakthrough could not be achieved. The chamber achieved this after a lengthy interim consultation in which the positions of both parties were weighed against each other.
Thereafter, the plaintiff accepts the severance payment of 40,000 euros offered by Adams but was able to extend the notice period by a further five months until the end of June 2021. All in all ten salaries since release at the end of August totaling 105,000 euros plus severance pay. The former operations manager can still use the company car until the end of June 2021.
