In a situation where the ‘Student Human Rights Ordinance’, which only emphasized student rights, is pointed out as one of the causes of the decline in academic rights, Seoul Superintendent Cho Hee-yeon held a one-person protest against the abolition of the ‘Seoul Student Human Rights Ordinance’ at Gwanghwamun Square in Seoul on the morning of the 13th.

Superintendent Cho said on this day, “There are claims that the recent series of malicious complaints against schools and violations of teachers’ educational activities are solely due to the student human rights ordinance, but I cannot agree with this.” He also argued, “The unilateral abolition of the student human rights ordinance will plunge the education field into chaos and conflict again.”

However, many point out that the student human rights ordinance is the cause of considerable confusion in schools. The provision guaranteeing students’ right to rest made it difficult for teachers to wake them up if they fell asleep during class. In the case of anti-discrimination provisions, if a teacher praised a specific student, it became grounds for complaints from other students. Since the death of a teacher in Seoul this year, some city and provincial offices of education with student ordinances are pushing for the abolition or revision of the ordinances.

Gyeonggi Province was the first to create a student human rights ordinance in 2010, and is currently being implemented by six city and provincial offices of education. The South Chungcheong Provincial Council will vote on the abolition of the student ordinance on the 15th. The Seoul City Council is planning to create an ‘Ordinance on the Rights and Responsibilities of Seoul School Members’ that specifies the rights and responsibilities of teachers, students, and parents. Next week, a bill to abolish the student ordinance will be submitted to the Seoul Metropolitan Council’s Education Committee and put to a vote at the plenary session. Superintendent Cho said he will hold a one-man protest throughout Seoul autonomous districts until the 22nd to block the abolition. In the education world, there is criticism as to whether it is right for a superintendent in charge of education policy to engage in a one-man protest like a politician rather than developing policies for teachers and students. One teacher said, “Problems with the human rights ordinance, which only emphasizes rights and no student obligations, continue to arise in the classroom, and we cannot leave it as is.”

Recently, the Ministry of Education created a ‘sample ordinance’ that clearly specifies the rights and responsibilities of teachers, students, and parents and distributed it to each office of education. However, National Human Rights Commission Chairman Song Doo-hwan sent a message to the Chungcheongnam-do and Seoul city councils asking them to ‘consider abolishing the ordinance,’ and some civic groups are also opposing the abolition.
