The sentences are lower than previously imposed by the court (14 and 12 years). When determining the sentence, the court looked at comparable cases and took into account in the sentence of the 23-year-old the fact that he stated “clear” to the police about the confrontation and with his clean criminal record.
A fight preceded the shooting. The 25-year-old man went to get a firearm, which the 23-year-old eventually shot. The victim died on the spot.
On appeal, the Public Prosecution Service has demanded 20 years against both of them, for murder. The Public Prosecution Service also demanded those sentences from the court. The court saw insufficient evidence for murder. The Public Prosecution Service has appealed against the court’s decision. But the court also finds murder not proven.
