A judge of Oviedo has condemned three young people, two of them from 25 years and a third of 21, to a multa individual from 360 euros for the injuries caused to another youth whom they attacked on the terrace of a cider house from Oviedo because He wore a mask printed with the flag of Spain.
The head of the Court of Instruction 2 of the capital considers that the three young people incurred a misdemeanor injury for which they must jointly pay a compensation of 480 euros to the victim and to the Emergency Service of the Principality of Asturias (SESPA) in the amount determined in execution of the sentence.
The events occurred on April 24, around 8:45 p.m., when the three young men were on the terrace of the ‘Sidrería La Estación’ establishment, located on Indalecio Prieto Tuero street in Oviedo, where the victim was in the company of some friends. The magistrate-judge considers it proven that one of the aggressors and the victim began to berate each other mutually on the occasion of an incident that they had both had the previous week as a result of a The mask worn by the attacked person, silkscreened with the flag of Spain.
Then, gave a shove to the victim who began to stagger, and at that moment, the other two defendants began to kick and hit him that made him fall to the ground, where he lost consciousness. A waiter from the establishment and the victim’s friends came to her aid and she was taken to the Central University Hospital of Asturias (HUCA).
The victim sustained injuries of which took 12 days to cure, and both the HUCA doctors and the forensic doctor’s report determined a causal relationship with the dynamics of the events manifested by the complainant, as stated in the sentence.
The complainant himself had argued in the trial that ethe incident he had had the week before to the aggression after the aggressor reproached him for wearing a mask with the flag of Spain “there was nothing left” since 15 minutes later he had shook his hand and apologized.
Sentence it is not firm and against it an appeal may be filed before the Provincial Court of Oviedo.
