Sergio DZ, sentenced in December 2019 for obsessively threatening and harassing civil guards and local police in Utebo, the municipality where he lived, has now been sentenced again for harass the lawyer who represented the officers who were victims of their threats. As a result of that sentence, in which fines totaling 1,560 euros were imposed on him and measures to remove him from the civil guards, Sergio DZ took it up with the lawyer Marco Antonio Navarro, who was forced to request a restraining order.
The violation of this measure and a new arrest for attack and threats against police officers in Zaragoza, led a judge to order his entry into provisional prison for 36 days. Despite this, his attitude continued and the lawyer denounced him again for coercion and a crime against the Administration of Justice, for which he was recently tried.
Now, the head of Criminal Court number 3 considers it proven that Sergio DZ has an aversion to the lawyer, whom he blames for the convictions he has had, that he has lost his partner’s job and assets. This was stated in court, from which he was expelled by the magistrate due to the threats he launched against Navarro in front of her.
The sentence states that while the different procedures against Sergio DZ were being processed, he insistently called the lawyer’s professional office, which initially did not pay much attention to his calls. The professional decided to block him later on WhatsApp because of the continuous messages he sent, but then he began to write SMS to him.
The messages were of the type “you put your mother in prison” · “enjoy what’s left of your lawyer” or “we’re going for you, let you knowwe will ask for your admission to prison”. In similar terms, the defendant mentions HERALDO, for being the medium where the judicial matters that concern him have been published.
The magistrate declares the harassment proven –the defendant himself acknowledged the authorship of the messages in the trial–applies the aggravating circumstance of recidivism He sentenced him to 15 months in prison and three years of restraint and prohibition of communication from the lawyer Marco Antonio Navarro, and one more year in prison and a fine of 1,080 euros for a crime against the administration of Justice.
In addition, the judge of Penal number 4 has also sentenced him, in another sentence dated March 31, like the previous one, a 14-month fine (2,520 euros) for a crime of violation of another sentence that he forbade him to communicate with the lawyer and that he did not comply when he asked for a friend request through Instagram. Although she denied that he was the one who sent the message and justified it by saying that someone had created a false profile, the magistrate did not believe it.
The judge collects in the sentence that throughout the intervention of the witness in the trial could verify the “accused’s hatred” towards the lawyer.
