The craftsman now lives in Gironde. He did not make the trip to attend his trial on Tuesday before the Thionville Criminal Court. Too bad, the case was judged without him.
A former client accuses him of having defrauded him. It all started in June 2019 in Basse-Ham. A resident asks his small company to change the windows of his accommodation. The estimate amounts to 15,553 euros. The customer pays a deposit by check of approximately 8,400 euros. The money is collected but the frames are never installed despite numerous reminders from the individual. The health crisis has been there and the craftsman thus justifies his delay. He invokes a delivery problem and then implicates a Polish supplier who, in the meantime, has gone out of business. He repeated these explanations to the investigators seized by the complainant. The contractor is first subject to a repayment schedule. He pays two small monthly payments, then nothing. The man, now 63, left the region.

Compensate the victim
“His business is still registered in the trade and companies register”, points out the victim’s lawyer, Ms.e Lagra. She would even have tracked down the alleged supplier. “He is in France and still active,” she believes. The lawyer denounces a botched investigation. It finds no evidence of any contact made between the craftsman and a supplier, here or elsewhere. “Monsieur simply had no intention of honoring the customer’s order,” she sums up.
The court sanctions the breach of trust and pronounces against the defendant, who has never been convicted so far, a suspended fine of 3,000 euros. The man will also have to reimburse the victim: 7,832 euros for his material damage, claimed by his counsel, and 200 euros for the moral repercussions caused by this case.
