As reported by the Spanish newspaper AS, the Provincial Court of Madrid upheld the appeal against the Mercantile Court number 17 and rejected UEFA’s opposition with a resounding ruling in favor of the Superleague. In the sentence, to which this newspaper has had access, the three magistrates of the court ensure that “FIFA and UEFA cannot justify their anti-competitive behavior as if they were the only custodians of certain European values, especially if this is to serve as an excuse to support a monopoly from which to exclude or hinder the initiative of what aspires to be its competitor, the Superlega”.
To this corrective, the judges add that “in the light of the information that has been made available to us, the behavior of the defendants does not seem justifiable to protect the general interests of European football, but rather that what we perceive is an action which has all the hallmarks of an unjustifiable abuse by those in a dominant position”.
So essentially, UEFA has no right to oppose the formation of the Super League, strongly desired by Juventus, Real Madrid and Barcelona and the latter two cannot be punished.
