An 88-year-old man injured a housemate so badly that she died a few days later. Now the demented senior has to answer in court.
Schliersee / Munich – The home should have been her shelter, but instead an 85-year-old was raped and injured so badly there last summer that she died a week and a half later. Since yesterday the perpetrator, a roommate (88), has to answer for rape and for murder before the district court Munich II.
He is severely demented and incapable of guilt. Leaning on a rollator and leaning forward heavily, the elderly gentleman shuffled into the courtroom. He was lovingly accompanied by two police officers. They helped him into the dock, the man’s gaze went dully forward.

On a July afternoon in 2020, he is said to have done terrible things in the scandalous senior citizens’ residence Schliersee (we reported). He had gone into the room just above his own, stripped himself and the bedridden woman naked, injured her badly with heavy blows and bites, and then offended her. At least that’s what the application said. The woman with dementia could not defend herself.
When the nurse on duty looked for the 88-year-old and looked out the window in his room, he saw the man’s face smeared with blood. Fearing a fall, he ran up one floor into the woman’s room and froze in shock. “He was naked, she was naked, there was blood everywhere,” reported the 30-year-old. The nurse had no idea that a rape had taken place here. He started the chain of reports and pushed the 88-year-old away from the bed.

He and a colleague had to carry the victim down the stairs. The elevator had stopped working for weeks because previous maintenance company bills had not been paid. “Normally that would never have happened,” said the nurse. Normally the woman would have been mobilized and given her coffee in the common room. But she hadn’t got out of bed for weeks. The nurse had pointed out the situation to the home management, “but that was ignored,” he said as a witness. He noted that something like this could not have been foreseen.
The 88-year-old was completely inconspicuous. “He was really nice and nice, always wanted to pay bills,” the 30-year-old recalled. When he came into the room, the man only said “burglar, burglar”. Because he could not follow the hearing and did not know exactly where he was, he was released from the requirement to be present. The police took him back to the mental hospital.
The proceedings are also concerned with his whereabouts there. He cannot be punished. The senior had expressed the wish to a forensic psychiatrist that he wanted to die quickly. He has nothing to reproach himself for, has never hit anyone. In his youth, the only 1.60 meter tall man was a successful boxer and had won several championships in his class. Presumably this was also the reason for the older lady’s serious injuries. Among other things, he had inflicted a serial rib fracture on both sides. The process is ongoing.
