Senegal: the Supreme Court jeopardizes Sonko’s chances of participating in the 2024 presidential election

The Senegalese Supreme Court delivered its verdict this Friday, November 17, 2023, on the appeal of the State of Senegal against Ousmane Sonko. Me Ciré Clédor Ly, lawyer for the opponent, shared the details of this decision which is attracting all the attention in the country.

Therefore overturns and annuls the Ziguinchor decision and refers it to the Dakar High Court”, reports the media, citing the Court’s decision.

Details from his lawyer

Reacting to this decision which marks a new turning point in this affair which has become an electoral dispute in Senegal, Me Ciré Clédor Ly, Mr. Sonko’s lawyer, carried out a scientific deciphering of the verdict. The lawyer essentially articulates his development around the jurisdiction of the District Court of Ziguinchor, Cassation and referral to the High Court of Dakar.

Ultimately, it should be noted that the Supreme Court canceled the re-registration of the candidate on the Senegalese electoral lists and referred the case to the Dakar district court. The time frame for the case to be retried is “extremely short,” according to one of Sonko’s lawyers. Indeed, the Attorney General had asked the Supreme Court to reject the appeal filed par the State Judicial Agent and to confirm the eligibility of Ousmane Sonko. But the judges did not follow the public prosecutor’s requisitions and overturned the decision of the Ziguinchor judge.

This decision, which comes just over three months before the presidential election, and one month before the end of the sponsorship collection, undoubtedly compromises Ousmane Sonko’s hopes of being able to be a candidate.

The lawyers’ disappointment

Babacar Niangone of Babacar Niang’s lawyers deplored the outcome given this Friday by the Supreme Court. “The judge did not want to take responsibility and left it to the tribunal of Dakar to rule on the merits”he regrets. “We hope that the case will be retried in the coming days”added his colleague, Me Saïd Larifou. The majority of them believe that the deadlines will be too short for the candidate to be reinstated on the electoral lists in time.
