The Senate of the Republic will approve next Tuesday a reform to the labor legislation, to establish that the first of October of every six years, when the head of the executive branch is sworn in, will be a mandatory day of rest for all workers in the country.
This is one of the pending issues that the current legislature received and that will be one of the first issues to be addressed. The report, prepared by the Labor and Social Security Commission, chaired by the then senator, Napoleón Gómez Urrutia, was read for the first time in the session last Thursday.
The intention is to harmonize the Federal Labor Law (LFT) with the provisions of the Constitution, the ruling states, since labor legislation continues to consider December 1 as the day of presidential handover.
It is detailed that in 2014, the decree of the so-called electoral reform was published in the Official Gazette of the Federation, which involved various modifications to the Constitution, to reduce the transition period between the presidential election and the inauguration of the head of the federal executive.
“Thus, Article 83 of the Constitution establishes that, starting in 2024, the inauguration of the President of the Republic will take place on October 1.”
However, “this is inconsistent with the provisions of the seventh section of article 74 of the LFT, which provides for mandatory days of rest and refers to the first of December of every six years, “when the transfer of federal executive power is due.”
For this reason, on February 14, 2024, Morena Senator Napoleon Gomez Urrutia presented an initiative to reform that section, so that it is in accordance with the Magna Carta, the opinion states.
It is also noted that in terms of labor law, this break every six years during the inauguration of the president of the republic, “constitutes the State’s recognition of the right of working people to take part in civic life and to be able to celebrate historical commemorations or fundamental civic acts.”
