The voters of Bondy (Seine-Saint-Denis) will they have to return to the polls? The judge still has to decide, but Thursday, October 21, 2021, the current mayor of Bondy, Stéphen Hervé (LR), has already announced that the government rapporteur “has chosen to follow the conclusions of the administrative court“.
In other words, the rapporteur recommends cancellation of results municipal elections in June 2020.
Towards new elections in January?
“This morning the public rapporteur delivered her conclusions before the judges of the Council of State and they are very clear: serious electoral irregularities allowed the list of Mr. Hervé to win the municipal elections of 2020 by a few votes. these should therefore be cancelled, ”reports Sylvine Thomassin (PS), the former mayor of Bondy, who lost the elections by 64 votes.
But it will be necessary to wait a few more weeks before having the final decision of the judge. “All of this is still conditional, we cannot yet commit to whether or not the elections are canceled”, cautiously comments a close friend of Stéphen Hervé. The judge’s decision should be made “within three weeks”, according to Sylvine Thomassin.
If the elections are canceled by the Council of State, neither of the parties has any possibility of appeal. Voters could then be called to the polls again during January.
A controversial leaflet
Following the example of the administrative court, the distribution of a leaflet containing a false article of the Parisian, motivated the rapporteur’s conclusions. In the columns of the leaflet, the mention of two complaints against Sylvine Thomassin as well as the opening of an investigation by the Bobigny prosecutor’s office for “offences of illegal taking of interests, passive influence peddling, embezzlement of public funds, complicity and concealment of these offences” would have influenced the vote.
The administrative court then considered that its broadcast on the eve of the second round of the elections did not allow Sylvine Thomassin “to respond usefully to this new element of the electoral controversy relating to her personal probity”. On the side of the City, we deny being at the origin of the distribution of the leaflet.
