Seine-Saint-Denis: 13 and 2 years in prison against the two brothers accused of the murder of Richard, in Les Lilas

Mamba Da Silva, 27, did he intend to kill 26-year-old Richard Fillion on the night of October 4, 2016 in Les Lilas? That was the whole issue of the trial before the Assize Court of Seine-Saint-Denis, in Bobigny. This young Romainville had been tried for a week with his brother Paowmi, 26, for murder. But only the eldest was found guilty of homicide by jurors.

This Monday, the general counsel, Olivia Farges, had no doubts about the murder. First, because “the blade entered a depth of 10 cm into the heart of the victim. The violence was such that a rib was severed. “Mamba Da Silva was aware that his act resulted in death. The victim was not killed by accident, ”she explains. Mamba’s lawyer worked with her colleague, Me Yann Le Bras, to meticulously dismantle the criminal charge for murder. “Mamba had just received two blows to the head, he was drunk and pissed off, that doesn’t mean he wanted to kill. He recognized the blows, but without the intention of killing ”. At his side Me Yann Le Bras emphatically supports the thesis of fatal blows and refutes the intention of homicide: “We are twisting reality for you,” he takes offense. If he had thought that a man was going to fall tonight. He wouldn’t have gone. Because he would have found himself with the whole city of Lilacs below his home ”.

That night in October 2016, Mamba holds out his knife and sticks it in the heart of Richard who has come to calm things down. Incredulous, the victim lets go: “Sica (Editor’s note: Mamba’s artist name) why me?” What did you do ? “. Richard was his friend, however, praised for his kind listening. He had encouraged Mamba in his budding career as a rapper. Mamba assures us that he did not recognize Richard when he delivered the fatal blow.

In the box next to Mamba stands Paowmi, 26, an almost twin brother. Like a copy pasted, the same murder is blamed on the youngest who did not yet stab Richard. The Advocate General explains that Paowmi must be considered as a co-author. “It’s a rare hypothesis: a single blow, yet two defendants are dismissed for murder. He did not carry the blade but he participated personally and directly in the murder: he came out armed with his brother and did not try to hold him back. It is enough to condemn them both for murder ”, she asserts.

“It’s unheard of: there is only one who inflicts a blow, but two perpetrators! “, Thunders Me Clarisse Serre, Mamba’s lawyer. “It’s absurd, there is only one wound”, strangles Me Olivier Arnod, counsel to Paowmi.

Soldered in pain, the victim’s family cannot hear him. Last Friday, Alain and Huguette, Richard’s parents, had testified to the unfathomable void left after his death. Her brother, Francis, said: “I have gone mad. I had an only brother and only one, he was taken from me ”. Monday, he screamed his anger in the hall of lost footsteps after the requisitions. The lawyer general had just asked for 15 years in prison for Mamba and 8 years for Paowmi for the murder of Richard. In a context of incessant rivalries between cities, Richard was the collateral victim of a conflict which did not concern him.
