Sedena fails to comply with the delivery of documents on flights of death

The Historical Clarification Mechanism (MEH) of the Commission for the Truth about the Dirty War denounced that the Secretariat of National Defense (Sedena) failed to comply with the deadlines ordered by the National Institute of Transparency and Access to Information and Protection of Personal Data ( Inai) for the delivery of documents on the so-called death flights, which took off from the Pie de la Cuesta base, in Guerrero, from where members of the Army threw dissidents of the PRI regime into the sea between 1973 and 1981.

In this sense, he once again urged the Sedena to provide the requested information and to fully comply with the resolutions of the Inai.

He explained that in the first case, the institute instructed Sedena to deliver file SC/034/2000/IV/IE-BIS, a preliminary investigation that the Military Prosecutor’s Office prepared 24 years ago on the death flights.

He stated that although the secretariat agreed to deliver a copy of the 8,704 pages, distributed in 13 volumes, the MEH received 1,143 pages – after payment of 8,684 pesos – and the rest was no longer delivered because On February 27, said agency notified them that “the military court in charge of said file declared it reserved.”

The above, he pointed out, “led to the complaint before the Inai, which in its session on April 3 instructed the Sedena to deliver a full copy of the file, setting April 22 as the deadline for compliance with its instruction.”

On the other hand, the MEH requested from the Sedena the list of the victims of the “Flights of Death”, of responsible persons who were prosecuted for these events, resolutions of the military justice authorities and the legal status of each one. of them.

However, the secretariat responded that the information was “non-existent”, so the Mechanism promoted the review appeal RRA 2751/24 before the Inai.

“In its session on April 10, this guarantor body instructed said Secretariat to deliver the requested information by April 29 of the current year.”

The MEH indicated that it continues the procedures before the Compliance and Responsibilities Directorate of the INAI to satisfy its request.

He stressed that resolution RRA 2751/24 is of interest to Mexican society, since “its legal argument associates the right of access to information with the right to the truth in matters of serious violations of human rights.”

He recalled that in its argument, the Inai took up criteria from the Inter-American Court of Human Rights and the Supreme Court of Justice of the Nation (SCJN), as well as the General Victims Law.

In relation to the names of the people who were responsible for the events, the institute resolved that: “a greater public interest is proven to make known the required information, namely, their name, the charges they faced, the resolutions handed down in their processes, as well as the legal status currently held by each of said persons.”
