General terms of delivery:
The place of performance for all contractual claims is the registered office of the seller (Greding). This also applies if the seller sends the goods to another destination at the customer’s request (sale by delivery to a place other than the place of performance). If the seller is also responsible for the assembly or installation of the goods at the customer, the place of performance is the place of assembly or installation of the goods.
Shipping charges are the responsibility of the buyer. The goods are sent to the delivery address indicated by the customer. Unless otherwise agreed, the seller is not obliged to ship the goods abroad.
If the customer operates as an entrepreneur and if, at the customer’s request, the seller sends the goods to a destination other than the place of performance, the risk of accidental loss of the goods passes to the customer as soon as the seller has handed over the goods to the carrier or to the person or institution otherwise appointed to make the shipment. The seller retains his right to payment of the purchase price.
If the customer acts as a consumer and if, at the customer’s request, the seller sends the goods to a destination other than the place of performance, the risk of accidental loss of the goods does not pass to the customer until of the delivery of the goods to the carrier or to the person or institution otherwise appointed to effect the shipment, if the customer has instructed the carrier, the freight forwarder or the person or institution otherwise appointed to effect the shipment of make the shipment and if the seller has not previously designated this person or institution to the customer. The seller retains his right to payment of the purchase price.
If the delivery of the goods fails for reasons for which the customer is responsible, the customer must bear the reasonable costs incurred by the seller as a result. This does not apply to return costs if the customer actually exercises his right of withdrawal. In the event of effective exercise of the right of revocation by the customer, the provision provided for in the seller’s revocation instructions applies to the return costs.
In the case of self-collection, the seller first informs the customer that the goods ordered by him are ready for collection. The customer can then collect the goods at the seller’s headquarters, after agreement with the latter. In this case, no shipping costs will be charged.
