FSecond division soccer team SC Paderborn is fighting on Monday (1:30 p.m.) before the administrative court in Minden for wage compensation payments for seven of its players. The authorities had ordered quarantine for employees of the association during the corona pandemic. Among them were not only physiotherapists but also football professionals. According to the Infection Protection Act, employers are entitled to compensation payments from the state.
As in the meat industry, there was a dispute about the payments. The country had rejected this. Reason: The physiotherapists and footballers could have done their job at home. In the oral hearing before the administrative court, the striker Dennis Srbeny and goalkeeper Jannik Huth are now to testify as witnesses. Both are still players in the SC Paderborn squad. The coach in 2020 was Steffen Baumgart, who is now under contract with the first division club 1. FC Köln.
In the meat industry, many companies were successful with their lawsuits in the first instance. Here, too, there was a dispute about wage replacement payments when separation from work colleagues was ordered. The administrative courts in Münster and Minden obliged the state to make the required payments. There were thousands of cases here.
In March, however, the Higher Administrative Court in Münster surprisingly agreed with the state for the first time. The Federal Administrative Court in Leipzig will probably deal with the question because of its fundamental importance. In the case of a physiotherapist, SC Paderborn was successful in the Minden court at the beginning of April. Here the administrative judges did not see how the employee of the association could have done his job at home. The verdict is not yet legally binding.
