Such action constitutes an offense under Section 243 (1) of the Securities and Exchange Act B.E. 2535 (the Securities and Exchange Act), punishable by Section 296 of the Securities and Exchange Act. The company includes Section 83 of the Criminal Code. Currently, the Securities and Exchange Act As amended by The Securities Act (No. 5) B.E. 2559 still provides that such act is an offense under Section 244/3 and shall be punished under Section 296 of the Securities and Exchange Act. The SEC therefore blames all 4 persons per NESDB to consider taking further legal action.
