In the past few days, the Lindau Criminal Police searched a total of five apartments in the Lindau district on suspicion of possession and distribution of child and youth pornography.
The searches were carried out on the basis of decisions that the court had issued at the request of the Kempten public prosecutor’s office. The suspects are men aged 17 to 53 years. Investigators found cell phones, tablets, computers, hard drives and USB sticks during the searches of the suspects’ homes. The data carriers and objects will now be evaluated by experts in digital forensics in accordance with the charge.
Some of the accused are accused of distributing child pornographic files via social media or messenger services. In two cases the accused were participants in chat groups with many members. Child pornography files were sent to them during their membership. One of the suspects also uploaded relevant files to the chat group.
The criminal investigation department points out that the possession of child pornographic files, for example on a mobile phone, will be prosecuted.
The automated storage of received media, as is the default setting for many messenger services, can already lead to ownership. If child or youth pornographic files are found on the devices and storage media during the execution of search warrants, these devices are subject to so-called confiscation. As a result, they will no longer get those affected back after the proceedings have been concluded, and there is also the criminal prosecution of the allegations.
