Mexico City. The case of Sandra Camacho Aguilar, a teenager raped, murdered and torn to pieces by Javier Méndez Ovalle on June 28, 2013, will be analyzed by the first chamber of the nation’s supreme court of justice, in response to a complaint appeal by the parents of the girl, Nieves Aguilar and Juan Camacho.
These, in a press conference at the doors of the highest court, expressed that they seek that justice be applied appropriately and that the numerous defects be corrected in all the legal instances that heard their daughter’s file, since all of them were violated. the criteria that should be applied in a case of Femicide.
This is the first case of feminicide that reaches the SCJN, so it constitutes a “historic opportunity” for the highest instance to establish a precedent on how to judge this type of crimes and how to issue a sentence to repair the damage with a focus on transformation in accordance with the highest standards of national and international justice, said the legal representative, Rodolfo Domínguez, of the Justice, Human Rights and Gender collective.
The opportunity for the Court to rule on a paradigmatic case of femicide like this one also means an opportunity for this team of judges, who will conclude the cycle next year, “closing their time in court with a flourish.”
This process occurs in a context of recurring impunity in courts at all levels, due to the tendency to make invisible and ignore all the aggravating factors that make up the crime classified as feminicide. In the specific case of Sandra Camacho, the evidence of the aggravating circumstances presented was not taken into account, among others, the forensic reports that demonstrated a particularly violent sexual attack against the victim, before her death, the bond of trust that was established by the aggressor and his exercise of power over a defenseless young woman.
The moment in which the court will hear and rule on this file is also characterized by a context of growing violence against women and an increasing trend in femicides, Dominguez Márquez recalled. In the country, six to nine women are murdered on average every day.
