Mexico City. The Supreme Court of Justice of the Nation (SCJN) rejected the arguments of the Government of Mexico and determined that the Federal Telecommunications Institute (IFT) is the competent authority to regulate communication via satellite in the country.
This Thursday, the plenary session of the highest court resolved a constitutional controversy promoted by the Legal Department of the Presidency of the Republic in which it was alleged that it was the power of the Executive to make the regulations.
“Satellite communication, by using the radio spectrum as a medium, falls within the scope of regulation of the Institute, which is, in accordance with article 28 of the Constitution, what regulates the use, exploitation and exploitation of the radio spectrum,” explained Minister Juan Luis González Alcántara Carrancá.
The autonomous body stated that it issued the new rules based on the Federal Telecommunications and Broadcasting Law, the Law of the Public Broadcasting System of the Mexican State and its own statutes.
Meanwhile, the Executive Branch accused that the IFT modified a regulation in force since 1997, issued by then President Ernesto Zedillo and maintained that with this it invaded the presidential powers and the Congress of the Union, by arrogating to itself the right to modify these on its own. rules.
