SCJN ratifies a fine of more than 5 million pesos for failures on the Chivas TV platform

Mexico City. The Second Chamber of the Supreme Court of Justice of the Nation (SCJN) ratified this Wednesday that Chivas de Guadalajara must pay three fines totaling 5 million 680 thousand pesos that were imposed for providing a service with technical failures on its Chivas TV platform, during the soccer match between the Guadalajara clubs against Monterrey on July 23, 2015.

The fines were imposed by the Federal Consumer Prosecutor’s Office on “Chivas de Corazón, a variable capital corporation,” for the failures presented on its internet platform (www.chivastv.mx) during said match.

“Given the ineffectiveness of the grievance concepts analyzed throughout the previous section, it is necessary to confirm the appealed sentence and deny constitutional protection to Chivas de Corazón, a variable capital corporation, contrary to the claimed sentence of the Superior Chamber of the Federal Court of Administrative Justice,” states the ruling.

These are two fines of one million 512 thousand pesos, one for violation of article 85 of the Federal Consumer Protection Law and another for violation of article 90, sections I and II; and another of 2 million 656 thousand pesos for also failing to comply with the provisions of article 76 bis, sections IV, V and VII.

“The supplier will avoid deceptive commercial practices regarding the characteristics of the products, so it must comply with the provisions related to the information and advertising of the goods and services it offers, indicated in this Law and other provisions derived from it. ”says section IV.
