Mexico City. The Supreme Court of Justice of the Nation (SCJN) reiterated its endorsement of nutritional labeling in prepackaged foods and beverages and, at the proposal of Minister Yasmín Esquivel, refused to protect the company Desde el corazón del corazón.
This Tuesday the full court analyzed a second injunction that sought to combat the measure for allegedly violating freedom of commerce among other rights by requiring the placement of seals that warn about substances harmful to health on their products.
“The point of comparison is not ideal, bulk foods preselected and packaged at the point of sale can be altered or modified according to their content, so it is clear that their composition changes according to the quantity the consumer purchases. While the first ones already contain established grammages with which you can see the quantity of the ingredients and if they are harmful to health, therefore they are products of a different nature,” explained Esquivel Mossa.
It will be until April 22 when the SCJN reviews the third protection on the issue that was promoted by Herdez, Nutrisa, Del Fuerte and McCormick jointly, this is because Minister Yasmín Esquivel will review whether all companies have the legal interest to request the protection against the label that warns that the product “Contains sweeteners. Not recommended for children.”
