On the sidewalk in front of a commercial building in Bern, two people had sex in the 69 position on Thursday, as a video shows.
“The whole thing is of course very questionable and obscene,” says a news scout.
According to the law, the act is already punishable – but only if someone reports it.
A news scout couldn’t quite believe his eyes when his colleague sent him a video from Bern’s Lorraine district on Thursday morning: It shows two people lying on the sidewalk and giving each other oral sex – in the so-called 69 position. The video is now circulating on Snapchat.
“We were amused about it, but of course the whole thing is very questionable and obscene,” says the 23-year-old. According to the reader, anyone who practices oral sex in public has lost all sense of shame.
The cantonal police in Bern have not received any reports in this regard, according to a request from 20 minutes.
Public sex is not prohibited
If nobody reports it to the police, public lovemaking remains unpunished. Because: In Switzerland, sex in public is not forbidden per se. However, it can fall under the criminal offense of sexual harassment, but only if someone reports it.
“Anyone who performs a sexual act in front of someone who does not expect it and thereby causes a nuisance, whoever physically or rudely sexually harasses someone with words will be punished with a fine upon request,” says Article 198 of the Criminal Code.
According to the criminal law of the canton of Bern, public sexual intercourse could also fall under “indecent behavior”. There would then be a fine of up to CHF 1,000.
