A former Taiwanese official, Zhang Xixian, the former First Overseas Chinese Affairs Secretary of the Sao Paulo Office of the Overseas Chinese Affairs Council (OCAC), has been impeached following allegations of sexual harassment against a female subordinate. The Control Yuan, Taiwan’s highest monitoring body, voted unanimously (12-0) to impeach Zhang on December 5th, citing a opposed work environment adn abuse of power.
The Control Yuan’s investigation revealed a pattern of inappropriate behavior by Zhang. According to the report, Zhang made disparaging remarks about the victim’s (referred to as “Otome” in the report) personal life to colleagues, including false claims about her relationships. He then pursued her aggressively, despite repeated rejections. The investigation detailed numerous instances of unwanted physical advances and attempts to control her movements, creating a climate of fear and intimidation.
“The impeached person’s emotional interaction with Otome has affected the reasonable supervision between the parties involved,” the Control Yuan stated in its press release. The report further noted that Zhang’s actions went beyond the bounds of professional supervision, creating a hostile, intimidating, and offensive work environment.
The OCAC’s own internal investigation also concluded that Zhang’s actions constituted sexual harassment. Furthermore, Zhang’s subsequent attempt to sue Otome for defamation was dismissed by prosecutors. The Taipei District prosecutor’s office stated that Otome’s account of the harassment was corroborated by evidence, including LINE messages with friends detailing the events and seeking advice on how to report the harassment.
“The LINE conversation record between Otome and her friend is sufficient to confirm that Otome began to confide in her colleagues about being sexually harassed by Zhang Xixian…and her colleagues also suggested…that Otome could seek channels to report her sexual harassment in a timely manner,” the prosecutor’s statement read. “Otome’s claim that she complained to her colleagues after being sexually harassed by Zhang Xixian is not false.”
The prosecutor’s office also dismissed Zhang’s claims of defamation, stating that Otome’s statements, while critical of her interactions with Zhang, were protected under freedom of speech. They were expressions of personal opinion and feelings, not false statements intended to harm Zhang’s reputation.
This case underscores the ongoing struggle to address sexual harassment in the workplace, even in seemingly progressive societies. The Control Yuan’s decisive action sends a strong message that such behavior will not be tolerated. The implications extend beyond Taiwan, highlighting the global need for robust mechanisms to protect individuals from workplace harassment and abuse of power.
The impeachment of Zhang Xixian serves as a stark reminder of the importance of creating safe and respectful work environments. It also highlights the need for clear reporting mechanisms and strong legal protections for victims of sexual harassment.
