On December 11, 2019, in Saint-Georges-de-Luzençon, a forty-something driving his car crashed into a vehicle and injured the driver. The latter suffers from several broken ribs and will ultimately have a total incapacity for work of 14 days.
Instead of making a formal report, the victim prefers to call the gendarmes. The driver indeed asked him to declare that it was his partner and not him who was behind the wheel. And for good reason, his driver’s license is suspended for a period of three months. His blood alcohol level revealed 0.56 mg of alcohol per liter of blood, or 1.12 g per liter of blood, a criminal rate.
“My client has since been declared disabled”, explains the civil party, who intends to seek compensation for the damage. The public prosecutor wonders about the conception, that the defendant, beneficiary of the RSA, of his addiction to alcohol. The latter denies any problem.
One month suspended sentence
“We can ask the question for lack of blood test proving the contrary.” He requires a one-month suspended sentence, the suspension of his license for three months and a fine of 200 to 300 € for the lack of insurance. The Millau court sentenced the defendant, with a clean criminal record, one month suspended prison sentence, the suspension of his license for three months and a fine of € 300. The consideration of civil interests has been postponed until April 15.
