Russian Ministry of Defense Proposes Uniform Age Limit for Military Service: Impact and Implications

The Russian Ministry of Defense has developed a bill that proposes to establish a uniform age limit for military service during mobilization, martial law or wartime. The law will affect those who entered the military before June 24, 2023. Department offers set 70 years as the age limit for senior officers and 65 years for all other military personnel.

The Ministry of Defense explains the need for such a law by the fact that currently there is no age limit for service for those who have entered into contracts until June 24, 2023. It is set only for those who did so after the specified date. It is indicated that the current legislation does not apply “to the entire period of mobilization and to legal relations that arose from the beginning of a special military operation (This is what the Russian authorities call the war in Ukraine – RS)”.

“The adoption of the bill will ensure the required level of staffing of the Armed Forces of the Russian Federation, while the level of combat readiness and combat capability of associations, formations and military units will not be allowed to decline during a special military operation,” the document says.

  • In May 2022, shortly after the Russian full-scale invasion of Ukraine, the State Duma raised the upper age limit for those wishing to sign a contract for military service. It was previously 40 years old, but has been raised to the statutory retirement age – 65 for men.
  • Last July, the State Duma adopted a bill raising the age limit for soldiers, sailors, sergeants, foremen, warrant officers and midshipmen to remain in the reserves by five years. The age limit for those liable for military service of the first category increased from 35 to 40 years, the second – from 45 to 50 years, the third – from 50 to 55 years. For senior officers with military ranks, the age limit for being in the mobilization reserve has been increased to 65 years, for junior officers – to 60 years.
  • In November 2023, Russian President Vladimir Putin, at a meeting with Russian bloggers and media workers writing about the war in Ukraine, said that volunteers and contract soldiers participating in hostilities on the territory of Ukraine will not return home until they are over – regardless of whether how long they entered into contracts with the Ministry of Defense or when they were mobilized.
  • Thus, if the new bill is adopted, contracted or mobilized military personnel, theoretically, if the mobilization decree is not canceled, can remain in the army until they reach 65 years of age, without the right to resign.
