The Appellate Specialized Criminal Court overturned the verdict of the Specialized Criminal Court under NOHD No. 1635/2019 and issued a new one in its place, which found the defendant, former Minister of Economy and Energy Rumen Ovcharov, guilty of intentional bankruptcy under Art. 219 para. 4 cf. para. 3 cf. para. 2 of the NC, from which significant damages occurred in the amount of “Mini Bobov dol” in the amount of BGN 2,659,040.60, justifying it for the difference up to BGN 24,455,474.80 .
On the basis of Article 54 of the Criminal Code, the defendant Ovcharov was sentenced to “IMPRISONMENT” for a period of TWO YEARS, the execution of which was POSTPONED for a period of FOUR YEARS.
On the basis of Article 37 paragraph 1 item 6 of the Criminal Code, the defendant Ovcharov is DEPRIVED of the right to hold public office in the bodies of state power for a period of THREE YEARS.
On the basis of Article 37 paragraph 1 item 7 of the Criminal Code, the defendant Ovcharov is DEPRIVED of the right to exercise activities related to the safekeeping and management of other people’s property for a period of THREE YEARS.
The judgment was handed down with a separate opinion of judge Rumyana Ilieva, and with the judgment of the Supreme Administrative Court, the civil claims filed in the case were completely dismissed.
With the same verdict, the defendant Ana Yaneva was found not guilty and acquitted of the charge of intentional neglect under Article 219 para. 4 clause 3 clause 2 clause 2 clause 26 clause 2 of the Criminal Code which caused damage in the amount of BGN 28,174,082.08.
With the same sentence, the defendant Plamen Evtimov – executive director and member of the Board of Directors of “Mini Bobov Dol” was found guilty of intentional bankruptcy under Article 219 paragraph 4 paragraph 3 paragraph 1 of the Criminal Code and this resulted in significant damages for the enterprise in the amount of BGN 2,681,733.30, justifying it for the difference of BGN 29,151,145.18.
Based on Article 54 of the Criminal Code, the defendant Evtilmov was sentenced to “IMPRISONMENT” for a period of TWO YEARS, the execution of which was POSTPONED for a period of FOUR YEARS.
On the basis of Article 37 paragraph 1 item 6 of the Criminal Code, the defendant Evtimov is DEPRIVED of the right to hold a managerial position in a state enterprise, corporation and public organization for a period of THREE YEARS.
On the basis of Article 37 paragraph 1 item 7 of the Criminal Code, the defendant Evtimov is DEPRIVED of the right to exercise activities related to the safekeeping and management of other people’s property for a period of THREE YEARS.
