Room IV agrees with an older adult who was denied a COVID vaccine for not having a card

(CRHoy.com) An adult over 86 years old received irregular treatment when she tried to get vaccinated against COVID-19 at the Tibás clinic managed by Coopesain, all because she lost her vaccination card.

According to a resolution of the Constitutional Chamber, the woman was denied the application of the third dose for having lost her card, and as a requirement she was asked to carry out a series of procedures considered excessive, since they are not within the guidelines established to access to the vaccine.

Said cooperative demanded from the woman a series of requirements that involved going to a bank agency, buying stamps, filling out a form, submitting the procedure for approval and going to another facility to receive the inoculation.

Due to this, the magistrates upheld an amparo appeal filed in favor of the woman.

“As was demonstrated in the amparo process, there is no requirement to present the card for the application of the vaccine against COVID-19 in the basic schemes offered by the CCSS… Subjecting the ward to excessive procedures for the application of the vaccine claimed is contrary not only to the principles of efficiency, effectiveness, speed, timeliness and convenience that should govern the provision of health services, but also to the special protection that the Political Constitution itself orders to provide to vulnerable populations, including – obviously – older adults”, the Court concluded in judgment No. 2022002994 of February 9.

The resolution did not establish a conviction against the clinic, for which it will not mediate the payment of damages or procedural costs.
