ROMA — Another blow to the company’s accounts Juventus. The Arbitration Board convened on the dispute with Cristiano Ronaldo, condemned Juventus to pay the Portuguese champion arrears of 9.8 million euros. And the decision is final.
“The Arbitration Board condemns Juventus FCSpA to pay Cristiano Ronaldo the sum of Euro 9,774,166.66, with the revaluation from the day of the amount due and the legal interest from the request to the balance on the annually revalued sum”. This is what we read in the 72 pages of the arbitration award, determined “by majority” and signed by the arbitrators Gianroberto Villa, Leonardo Cantamessa e Roberto Sacchi (only contrary). Ronaldo, supported by lawyers John Shehata e Salvatore Pino he was asking for the entire arrears: 19.5 million euros. But the arbitration award wanted to exclude Juve’s desire to deceive the player with the salary maneuver. And “Juventus must be held responsible for the damage suffered by Ronaldo due to the loss of wages, but the injured party must suffer a reduction in compensation, equal to half” because he did not request them. So, by inertia.
Juventus’ defense
The club replies: “The referees found that the ‘Ronaldo card’ has no binding effect; they rejected his requests for nullity of the salary reduction agreement and for fulfillment of the integration agreement; they also rejected the request for annulment of the compensation reduction agreement, noting the absence of malice on the part of the company”. For the Bianconeri, the referees only “ascertained Juventus’ pre-contractual responsibility deriving from the failure of the negotiation. The company, with its lawyers, is examining the decision, reserving any evaluation and initiative to protect its rights”.
Juventus’ defense argued that CR7 had given up on asserting any economic claim against the club in the Transfer Agreement signed with Manchester United in 2021: in fact, the contract for the Juventus club would contain a clause that would replace any previous agreement with Juventus and a express renunciation of the player to any dispute. Furthermore, for Juve there would have been no agreement on the salary supplements linked to the 2nd salary package, or in any case it would not have been finalized. The reason? CR7’s signature was missing.
Because Ronaldo won
But in the arbitration award this position of the Juventus club is not recognized: “The contract refers to the transfer of the player to another team, it indicates a fee for this performance, but no provision can be identified referring to the replacement of the previous current obligations between Juventus and Ronaldo ”. Translated: there are no references to the money that Ronaldo should have, nor can it be deduced why such a thing “is not presumed”, it is stated. And there’s nothing to say that money is no longer owed.
Not only that: the arbitration award also refers to the investigation by the Guardia di Finanza into the accounts and to a famous note, recalling that in that sea of papers “a conversation between the General Counsel is recalled Cesare Gabasio and the manager Federico Cherubini which refers to concerns and hypotheses of delay relating to the amount of 19 million”. And these and other conversations “would be completely irrational if there had actually been a waiver of Cristiano’s rights.” It therefore remains a very hard blow.
