Rome, the appeal on the Diawara case rejected: the 3-0 at the table at Verona confirmed

ROME REJECTED APPEAL – The ruling on the Diawara case. After the appeal of the Roma for the decision of Sports Judge to assign 0-3 at the table to the detriment of the Giallorossi club, the National Sports Court of Appeal confirmed the last provision and therefore canceled the result of the field of the match against Verona, finished 0-0. The Serie A standings therefore remain the same: Roma remain at 14 points, -3 from Milan leaders.

The judging panel of the Court of Appeal, chaired by Lorenzo Attolico, yesterday had heard the CEO Guido Fienga and the lawyer of the Capitoline company Antonio Conte, who reiterated the absolute good faith of the error and underlined how it did not bring any kind of advantage. Nothing to do, however, Roma’s only defeat of the season remains ‘of office’.

As part of the FIGC press release states: “The appeal is groundless. The preliminary request, formulated by the complainant company, to hear the team manager of AS ROMA SpA, Mr. Gianluca Gombar, since he would be called to report on a factual circumstance (the interview with the delegate
of the Serie A Football League on the alert generated by the computer system regarding the inclusion in the HELLAS-VERONA-ROME match sheet of 19.9.2020 of the player DIAWARA Amadou) completely irrelevant, given that it is clear, having been admitted the complainant company, the violation of the provisions of CU n. 83 / A of 20.11.2014.

The CONI Sports Guarantee College has found that the list of 25 players that can be used in the league, of which at least four trained in the club and at least four trained in Italy, is essential for the protection of the national nursery, with the methods and timing transmission to the Serie A League, and with the consequence that the player, DIAWARA Amadou, could not be deployed on the pitch at the football match HELLAS VERONA ROMA, held on 19.9.2020.

Point 8) of CU n. 83 / A of 20.11.2014, in fact, expressly provides that ‘It is forbidden for players not included in the list of 25 players to participate in league matches during the period of validity of the list itself’.

Point 9) of the aforementioned CU provides, always expressly, that ‘The use in a league match of a player not included in the list of 25 players entails, for the responsible club, the sanction of the loss of the match pursuant to’ art. 17, paragraph 5, lett. a) of the Code of Sports Justice (now art. 10, paragraph 6, letter a) of the new Code of Sports Justice), as this player does not have the right to participate in the match ‘”.
