The Public Ministry summoned INVIAS, ANI and the Ministry of Transportation to a follow-up table to give explanations about the negative impact of the measure on the pocket of Colombians and the contingency plans in this regard.
Faced with the imminent rain of lawsuits that would be generated by the freezing of toll rate readjustments, by the National Highway Institute-INVIAS- and the National Infrastructure Agency-ANI-, the Attorney General’s Office set off the alarms and expressed concern about the many transportation infrastructure projects that could be put at risk, generating insecurity in the financial market that allows the sustainability of 4G and 5G road projects.
In a follow-up table, with the participation of INVIAS, ANI and MinTransporte, as well as the accompaniment of the State Legal Defense Agency, Min Hacienda and the Colombian Chamber of Infrastructure, the mechanisms for the recognition of toll rate adjustments and the possible planning and estimation of budget items necessary to guarantee the services related to the country’s road infrastructure were exposed.
Among the risks detected is the enormous deficit of approximately 900 billion pesos that was not received for toll collection in 2023, which could unleash an imminent flood of lawsuits against the State for breach of contractual commitments and lack of confidence in the infrastructure market, affecting the finances of all Colombians.
Faced with this, the control entity summoned those involved in the situation and inquired about the plan to mitigate each of the risks that have already been presented and that could lead to the collapse of the country’s road infrastructure projects.
In its preventive action, the Public Ministry urged the entities to work together to speed up the execution of the shock plan and announced that it will continue to ensure guarantees for the development of road infrastructure in the country and avoid patrimonial detriment that affects all citizens, sending a message of legal and financial security.
