Member of Commission III DPR Asrul Sani’s PPP faction highlighted the prosecutor’s demands against Rizieq Shihab heavier than the higher-ups Sunda Empire Ranga Sasana. Both were charged with the same article, but Rizieq was charged more severely.
Arsul conveyed this with the Attorney General ST Burhanuddin at the House of Representatives Commission III, Jakarta, Monday (14/6). According to him, there is a difference in the attitude of the prosecutor towards the accused who often criticizes the government.
“The demands are different if the perpetrators are not people whose political positions are at odds with the government or those in power,” said Arsul.
“For example, I see this disparity, which is currently underway, for example in the case of Rizieq Shihab,” he continued.
Arsul said that Rizieq, the leaders of the Indonesian Rescue Action Coalition (KAMI) Syahganda Nainggolan and Ratna Sarumpaet were required to be sentenced to a maximum of 6 years in prison for cases of spreading false news to cause trouble.
Prosecutors filed a different lawsuit against the defendant who did not have a political position opposite to that of the government.
“Let’s see, for example, if his political position is not at odds with the government. Say, about the case of senior officials of the Sunda Empire Nasriban, Ratna Ningrum, Ki Raggga Sasana, the demands are 4 years,” he said.
Arsul considered that often such demands give the impression that the Attorney General’s Office is no longer purely an instrument of the state to enforce the law, but has instead become an instrument of power.
Asrul refers to the issuance of the Attorney General’s guideline number 3 of 2019 concerning Criminal Prosecutions in General Crime Cases which he considers to change the habit of prosecution at the prosecutor’s office.
“I saw that there was a disparity after the issuance of this guideline,” said Asrul.
Attorney General ST Burhanuddin who was present at the meeting agreed that the disparity of demands often occurs in the field.
He immediately ordered the Deputy Attorney General for General Crimes to focus so that there would be no more disparity in the prosecution of general criminal cases.
“So that the Jampidum will not happen again. Even though we give authority to the regions. But the supervision is still with us. Don’t let this disparity happen again,” he said.
