Ristori quater decree, limit reaches the jaws of the taxman

Stop the jaws of the tax authorities and other enforcement procedures if the taxpayer presents or has submitted an application to ask for a deferral of his tax debts for proven economic difficulties in paying. It is one of the innovations contained in the new Ristori decree (the fourth) which will be examined on Sunday morning by a Council of Ministers with the aim of launching it in the evening of the same day.

The text provides postponement of deadlines tax of 30 November (income taxes and Irap) to 10 December and new one-off aid for seasonal workers in tourism, entertainment and for workers employed in the sports sector. Support for the trade fair and congress sector, the postponement of elections for trade union representation bodies, the postponement of some fiscal federalism deadlines, the right to extend the duration of listed real estate funds and funds for the police forces, fire and for the emergence of irregular work.

The limit to the jaws

The blocking of the possibility for the taxman to activate the executive procedures ranging from foreclosure to administrative detention will not concern the practices already activated but will trigger immediately after the presentation of the application that the taxpayer will do to obtain the extension. The rule provides that the statute of limitations and forfeiture periods are also blocked upon submitting the application. For the blocking of foreclosures and administrative stops, the “proven” economic difficulties are demonstrated for sums registered in the role with amounts exceeding one hundred thousand euros.

Compensation for tourism workers

The text (in the draft circulated on Saturday evening) provides for an indemnity of one thousand euros in favor of workers in the tourism, entertainment and spa sectors who have ceased their employment since January 1st and who are not pensioners, or have another employee job and do not receive Naspi. The same draft decree also provides for an indemnity of 800 euros in favor of workers employed with collaborative relationships with amateur sports clubs and associations, Coni and the Italian Paralympic Committee.

More resources for police and firefighters

With the Ristori quater decree, new resources are arriving to finance the police forces, including the local one, and the firefighters dealing with the Covid emergency. From 25 November and until 31 December for the carrying out of the major tasks related to the coronavirus, the provisional text of the decree reads, an expenditure of 62.3 million is authorized for the payment to the personnel of the police forces divided as follows: 48.5 million for public order allowances and 13.7 million for overtime. For the same period, a further expenditure of 5.3 million is allocated for overtime work by the fire brigade.
