Bianca Pilath, the travel law expert at the Herne advice center, had, among other things, a case on the table that had been triggered by the ban on accommodation: According to Pilath’s description, two older women from Herne started a bus trip on Friday, October 9th at 6:30 a.m. Moselle should lead. But at the stop in Koblenz there was a nasty surprise: In the meantime it had become known that Herne had exceeded the incidence value of 50 – and was therefore a risk area. The hotel on the Moselle had also registered this and informed the travel company that the guests from Herne would not be accepted because of the ban on accommodation.

Since other guests were also on the bus, the bus driver could not turn back. So the two women were brought to the train station, from there they took the train to Gelsenkirchen, where the travel company picked them up and brought them home. The consultation revolved around the question of what percentage of the travel price must be reimbursed.

The closure of the fitness studios also played a bigger role in the consultations, said Veronika Hensing, head of the advice center. The question is repeatedly asked whether customers have to continue to pay their contribution. In the opinion of the consumer association, consumers are no longer obliged to pay their contribution because of the “impossibility of performance”, which is described in the Civil Code under Paragraph 275.

However, there are some details to consider in this area, such as the possibility of credits or the question of how many days it was (and is) closed. Consumers need to know this in order to calculate the exact amount that they do not have to pay.
