Mexico City. Minister Margarita Ríos Farjat proposed this Monday to the Plenary Session of the Supreme Court of Justice of the Nation (SCJN) to urge the congress and electoral authorities of Oaxaca to take the necessary measures to reserve candidates for the governorship of that state in the elections for women. from 2028 and 2030, in order to comply with the rule of gender parity under equal conditions.
The proposal, which will be resolved next Thursday, was presented in session when analyzing the validity of the constitutional reform of Oaxaca that established that in 2028, for the only time, the period in the governorship will be for two years to tie the following renewal with the election to the Presidency of the Republic.
This reform, published in Decree 1624 on December 30, 2023, was challenged through an Unconstitutionality Action by the National Action and Popular Unity parties under the argument that it affects gender alternation in the governorship.
“If there is a risk that a woman will be the one who suffers the effects of this reform, the one who governs at this moment in Oaxaca is a man, so if the alternation is implemented, the next one would be a woman, who would only have a period of 2 years so that in 2030 a man is elected again who would serve for a full period of 6 years,” said the minister.
Minister Ríos Farjat’s project proposes to the Plenary Court to validate Decree 1624 that reduces the period in the governorship. However, there were positions against it, such as that of Alberto Pérez Dayán, who considered that it should be invalidated because it affects the constitutional mandate of gender parity.
“This harmonization, even though it could have a good purpose, unfortunately coincides with what was already ordered and this would lead, in conclusion, to understand that the process in which the candidates will be precisely women, is when it was diminished to be simply and simply two years, for which, then, the constitutional postulate that gender parity must be a reality, and this must always occur under equal conditions, is not met… I would be more in favor of considering this provision for now, and considering your background if it gives rise to a suspicious classification that leads to your disability,” he said.
The vote on the Ríos Farjat project was left for next Thursday, so that the minister can add the proposal to exhort the Oaxaca authorities and give the ministers the opportunity to study it.
