Bern: Obstruction of the police – riding school owner receives fines

In October 2021, a suspicious person fled into the inner courtyard of the riding school, whereupon the gate was locked from the inside.

At a party in July 2022, the police criticized the fact that the security guards were not sufficiently recognizable as such.

The riding school owner has now been fined for the two incidents.

The riding school is sometimes referred to as a “legal vacuum”. The Bern cantonal police complain that their operations near the autonomous cultural center are regularly hindered. Critics accuse the riding school of consciously tolerating these conditions. So far there have been no legal consequences. But now the Bern public prosecutor’s office has found an employee of the cultural center guilty of two incidents, such as: Berner Zeitung reported.

The first occurred on October 19, 2021, when a person suspected of robbery escaped into the courtyard of the riding school and the gate was then locked from the inside to ward off the police. In the second case, at the Soli summer festival on July 2, 2022, the police complained that the riding school’s security service was not specifically marked and calls went unanswered.

Did not appear in court

The penalty order is directed against the 29-year-old riding school owner. The public prosecutor found him guilty of “multiple violations of the Hospitality Industry Act”. He has to pay a fine of 1,300 francs. The man was not directly involved in the two incidents. As the license holder, however, the riding school owner must ensure “flawless business management” and “instruct his employees accordingly,” argues the public prosecutor’s office.

When it comes to the fine, the public prosecutor’s office relies on the security concept of the autonomous cultural center, which was last adapted in 2020 in collaboration with the city of Bern. Accordingly, security employees must be “recognizable to third parties”.

The accused originally challenged the penalty order. However, because he did not appear at the court hearing, the objection is considered withdrawn and the penalty order is considered legally binding.
