A Kolkata court granted bail to two Indian officials implicated in the investigation of a junior doctor’s rape and murder. Sandip Ghosh, the former principal of RG Kar Hospital, and Abhijit Mondal, the former officer-in-charge of Tala police station, were released after the Central Bureau of investigation (CBI) failed to file charges within the legally mandated 90-day timeframe.
The horrific crime, which involved the rape and murder of the young doctor, occurred on August 9th. Her body was discovered in the hospital’s seminar room. The CBI, taking over the investigation following a Calcutta High Court order, arrested Ghosh and Mondal on September 14th. They were accused of tampering with evidence and delaying the filing of the initial police report (FIR).
While the CBI had already filed charges against the primary suspect, Sanjay Roy, a civic volunteer, the agency’s failure to meet the deadline for Ghosh and Mondal’s case led to their release. The additional chief judicial magistrate (ACJM) granted bail, setting a bond of ₹2,000 each, with the condition that they cooperate with the ongoing investigation.
The former police officer, Mondal, is expected to be released from jail immediately. However, Ghosh’s situation is more complex; he remains in custody due to a separate case involving alleged financial irregularities at the hospital.
During the court hearing, the defense lawyers argued for their clients’ release, citing the CBI’s failure to meet the 90-day deadline. Mohd Zakir, the lawyer for the suspended police officer, stated, “My client has suffered for more then 90 days. May he be released.”
The CBI’s counsel acknowledged the court’s authority to grant bail, stating that the agency was not filing charges at that time. The investigating officer confirmed the ongoing nature of the probe, stating, “the investigation is in process, but we are not filing chargesheet.”
In its ruling, the court stated: “In this case no chargesheet has been filed against the accused — Abhijit Mondal and Sandip Ghosh — till today, and today is the 90th day of them being in custody. Hence, the accused persons are directed to find a bail bond of `2,000 each. Both the accused are directed to assist the prosecuting agency as and when they are called on, to investigation by the CBI and to appear before the court on the next date henceforth.”
Prior to the bail hearing, the CBI had presented evidence suggesting Ghosh and Mondal attempted to cover up the crime. the CBI stated, “There are a number of recorded incriminating calls, as well as videos, in the extracted data from the cellphones of both (Mondal and ghosh).” The investigation continues.
