Under the new city rules, which will come into effect on April 1, 2023, residential buildings would have up to three options:
- Take out the trash after 6pm in a container with a secure lid.
- Take out the trash after 8pm if you put your bags directly on the curb, or
- If a building has nine or more residential units, the owner can choose a time from 16:00 to 7:00 instead. The subscription period will run until January each year, allowing DSNY to design efficient routes starting April 1st.
At the press conference that announced the new plan on Monday, Adams denounced the current policy as outdated, saying it has been in effect since 1969.

The city also said the Department of Health is harvesting more on the midnight shift than it did before the pandemic. This overnight collection is around a quarter of all collection operations, which translates to around £ 5 million each night.
The proposed rules are subject to public comment under the City Administrative Procedure Act. The comment period is open until Thursday 10 November and a public hearing is scheduled for that day at 9:30 am. Once public comments are taken into account, the Department of Health will publish the final new rules later this year. .
